While we endeavor to keep schedules up to date, Total Happy Hour makes no guarantees, representations, or warranties regarding the absolute accuracy, completeness, or reliability of any promotional menu or schedule listed on the Service. You are encouraged to verify promotional details directly with the venue before ordering.

B. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TOTAL HAPPY HOUR, INC. AND ITS SUPPLIERS, LICENSORS, AND AGENTS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

C. Limitation of Liability

IN NO EVENT WILL TOTAL HAPPY HOUR, INC., OR ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY FOR: (I) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (II) THE COST OF PROCUREMENT FOR SUBSTITUTE PRODUCTS OR SERVICES; OR (III) ANY MATTERS BEYOND TOTAL HAPPY HOUR’S REASONABLE CONTROL.

7. Termination and Account Deletion

Total Happy Hour reserves the right, without notice and in its sole discretion, to terminate or suspend your license to use the Service and to block or prevent your future access to the Service if you violate any portion of these Terms.

• Voluntary Account Deletion: You may terminate your account at any time by selecting the “delete account” link on your account settings page.

• Data Processing Upon Termination: Upon account deletion, your public profile, historical check-ins, earned badges, and custom promotional items will be removed from active interface servers. Residual system data may persist within encrypted database backups for up to ninety (90) days prior to permanent erasure.

8. Governing Law and Dispute Resolution

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding arising out of or relating to the Service shall be brought exclusively in the state or federal courts located in Clark County, Nevada.
